تحفيظ أراضي الضم
إذا كان نظام التحفيظ العقاري يهدف إلى خلق أرضية قانونية وهندسية صلبة للملكية العقارية، فإن المشرع المغربي فضلا عن مسطرة التحفيظ العادية، عمل على إقرار بعض المساطر الخاصة بالتحفيظ العقاري الهدف منها تعميم هذا النظام، ومن بين هذه المساطر نجد مسطرة ضم الأراضي الفلاحية إلى بعضها البعض، مسطرة التحفيظ الجماعي… إلا أنه لن نتعرض لكل هذه المساطر بقدر ما ستنحصر دراستنا على مسطرة ضمن الأراضي الفلاحية.
وقد حاول المشرع المغربي خلال الفصل الاول من ظهير 30 يونيو 1962 أن يعرف علمية ضم الأراضي انطلاقا من غايتها، وذلك بتنصيصه على أنه تنحصر الغاية الأساسية من ضم الأراضي الفلاحية بعضها إلى بعض في تحسين اساليب الاستغلال بجمع واعادة ترتيب القطع المبعثرة أو المجزأة أو التي لها شكل منتظم لتتكون منها أملاك موحدة الأطراف أو أملاك محتوية على قطع أرضية كبيرة منسجمة الشكل ومضموم بعضها إلى بعض تساعد على الوصول إليها وريها وصرف المياه منها وبوجه عام تكون صالحة للاستفادة من التحسينات العقارية الممكن إدخالها عليها.
أما على المستوي الفقهي[1] ضمن الأراضي الفلاحية هي تلك العملية التي يكون الهدف من ورائها دمج مجموعة من العقارات المتجاورة والموجودة في منطقة محددة واعادة توزيعها لأجل استغلالها بطريق أكثر فعالية.
وأن أول مبادرة لعملية ضم الأراضي بعضها إلى بعض في بلادنا كانت سنة 1920 بإقليم بني ملال خارج أي إطار قانوني، وقد حاول المشرع المغربي من خلال سَنِّهِ لظهير 8 مار س1952 التأطير القانوني لهذه العلمية، ومن تم وضع أسس سياسية معينة لضم الأراضي الفلاحية بعضها إلى بعض عبر إصدار مجموعة من الظهائر التي تم إلغاؤها بموجب ظهير 30 يونيو 1962 المنظم لعملية الضم، والمرسوم التطبيقي المؤرخ في 25 يوليوز 1962، وقد تم تعديل الظهير المذكور بواسطة ظهير آخر مؤرخ في 25 يوليوز 1969.
